Arogga Doctor Consultancy – Terms and Conditions (For Doctors)
Welcome to Arogga Doctor Consultancy ("Arogga", "Platform", "App", "we", "our", "us"). These Terms and Conditions ("Terms") govern the relationship between Arogga and registered medical professionals ("Doctor", "you", "your") who provide consultation services through the App.
By registering, accessing, or using the App as a Doctor, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the App immediately.
1. Eligibility and Registration
1.1 To provide services through Arogga, you must:
- Be a qualified medical practitioner recognized in Bangladesh.
- Hold a valid registration with the Bangladesh Medical & Dental Council (BMDC).
- Provide accurate personal, professional, and licensing information during registration.
1.2. Arogga reserves the right to verify your credentials and reject or suspend accounts that fail verification.
1.3. You confirm that you are legally allowed to provide telemedicine consultation under the laws of Bangladesh.
2. Scope of Services
2.1. Arogga provides a digital platform enabling Doctors to offer medical consultation to patients through:
- Chat consultation
- Audio consultation
- Video consultation
2.2. You acknowledge that Arogga is a consultation platform only and does not guarantee the number of patients or consultation requests.
2.3. Emergency medical services are not provided through the App. Doctors must advise patients to call 999 or visit the nearest hospital for emergency cases.
3. Doctor Responsibilities
Doctors agree to:
- Maintain valid BMDC registration at all times.
- Provide consultations professionally and ethically.
- Follow all applicable medical guidelines, telemedicine regulations, and Bangladeshi laws.
- Provide advice based on patient history, symptoms, and medical information provided.
- Maintain respectful and professional communication with all patients.
Doctors must not provide consultation while under the influence of drugs, alcohol, or any condition that may impair judgment.
4. Medical Disclaimer
4.1. Doctors understand and accept that online consultation has limitations and may not replace physical examination.
4.2. Doctors shall recommend in-person medical visits or diagnostic tests whenever necessary.
4.3. Doctors are responsible for ensuring prescriptions and advice are appropriate and safe according to the information available.
4.4. Arogga is not responsible for treatment outcomes resulting from incomplete, false, or misleading patient information.
5. Professional Conduct and Ethics
Doctors must not:
- Misbehave, harass, or use abusive language toward patients.
- Discriminate based on religion, gender, ethnicity, disability, or social status.
- Request personal favors, money outside the platform, or inappropriate relationships.
- Share or disclose patient data without lawful justification.
- Engage in unethical or illegal medical practices.
Violation of professional ethics may result in immediate termination and reporting to BMDC or legal authorities.
6. Consultation Rules
6.1. Doctors must attend consultations on time as per scheduled bookings.
6.2. If a Doctor repeatedly misses appointments, Arogga may reduce visibility, suspend, or terminate the Doctor account.
6.3. Doctors should maintain proper communication quality and stable internet connection for video/audio consultations.
6.4. Doctors must provide prescriptions only when medically justified.
7. Payments, Fees, and Commission
7.1. Doctors will receive consultation fees as per Arogga’s payment policy.
7.2. Arogga may charge a service fee or commission from each completed consultation. The applicable percentage will be disclosed in the Doctor dashboard or agreement.
7.3. Payments will be processed through approved payment methods and disbursed within the scheduled payout cycle.
7.4. Arogga reserves the right to hold payments in case of disputes, fraud investigation, or legal compliance requirements.
8. Cancellation and Refund Policy
8.1. If a consultation is canceled by the Doctor without a valid reason, Arogga may apply penalties or reduce account ranking.
8.2.If a consultation is canceled due to verified technical issues from Arogga's side, the patient may be refunded and the Doctor may be compensated depending on policy.
8.3.Refunds and dispute resolution will be handled according to Arogga's internal policies.
9. Privacy and Confidentiality
9.1. Doctors must treat all patient information as strictly confidential.
9.2. Doctors must not record, store, screenshot, or share consultations, medical reports, or patient conversations without written patient consent and legal justification.
9.3.Doctors must comply with Arogga's Privacy Policy and Bangladesh data protection practices.
9.4. Patient data may only be disclosed if required by law, court order, or regulatory authority.
10. Intellectual Property
10.1. All App content, logos, trademarks, design, and software are the intellectual property of Arogga Doctor Consultancy.
10.2. Doctors are granted a limited, non-transferable right to use the platform only for providing consultations.
10.3.Doctors may not copy, modify, reverse-engineer, distribute, or exploit the platform's software or content.
11. Prohibited Activities
Doctors must not:
- Provide fake medical credentials.
- Provide misleading medical advice intentionally.
- Prescribe controlled medicines illegally.
- Promote third-party products or services for commission without Arogga approval.
- Encourage patients to bypass the platform for personal payment.
- Attempt to hack, disrupt, or misuse Arogga systems.
12. Account Suspension and Termination
12.1. Arogga may suspend or terminate a Doctor account if the Doctor:
- Violates these Terms.
- Engages in unethical or illegal conduct.
- Receives repeated serious complaints.
- Fails BMDC verification.
- Damages Arogga's reputation.
12.2. Arogga may also suspend accounts for security, fraud prevention, or legal reasons without prior notice.
12.3. Terminated Doctors may lose access to the platform and ongoing services.
13. Limitation of Liability
13.1. Arogga acts as a technology platform and is not responsible for:
- Medical outcomes or patient recovery results.
- Misuse of medical advice by patients.
- Errors caused by false or incomplete patient information.
- Connectivity issues or device failures beyond Arogga's control.
13.2. Arogga shall not be liable for indirect, incidental, or consequential damages.
14. Indemnification
Doctors agree to indemnify and hold harmless Arogga, its employees, directors, and partners from any claims, damages, penalties, losses, or legal actions arising due to:
- Medical negligence or malpractice by the Doctor.
- Violation of Bangladeshi law or BMDC regulations.
- Breach of confidentiality.
- Misrepresentation of credentials.
15. Governing Law and Jurisdiction
15.1. These Terms shall be governed and interpreted under the laws of Bangladesh.
15.2. Any disputes shall fall under the exclusive jurisdiction of the courts of Bangladesh.
16. Changes to Terms
16.1. Arogga reserves the right to update or modify these Terms at any time.
16.2. Continued use of the App after updates constitutes acceptance of the revised Terms.
